Perth reaches mediated settlement in long-running CAIVAN subdivision dispute

After nearly a year of mediation led by the Ontario Land Tribunal (OLT), the Town of Perth says a settlement has been reached regarding a controversial subdivision proposed by CAIVAN (Perth GC) Limited.
The case, which has continued to draw significant local attention, has been before the OLT under file number OLT-23-000534, with mediation sessions held throughout 2025. According to a release from the Town of Perth, meetings took place this year on Feb. 14, Mar. 16, Apr. 30, May 30, Aug. 19, Sept. 23 and Oct. 23. The sessions brought together the Town of Perth, Lanark County, CAIVAN, legal teams, expert witnesses and a mediator.
“These sessions allowed all parties to present information, clarify issues, and work through areas of agreement and disagreement under the guidance of the Tribunal-appointment mediator,” said the town.
With mediation now concluded, the matter will move into the formal approval stage of the OLT process, which was detailed by the town as follows:
- Minutes of Settlement drafted: Lawyers for all parties are currently preparing the official settlement document.
- Review and signing: Once the draft is complete, the Town of Perth, Lanark County and CAIVAN will review and sign it.
- Public release: After approval, the Minutes of Settlement will be made publicly available.
- Public meeting planned: The town will hold a public meeting — as early as January 2026 — to explain the settlement and allow residents to ask questions. Details will be announced when finalized.
- Participant updates: Individuals or groups with formal “participant” status in the OLT appeal will be able to revise or withdraw their previous submissions.
- OLT hearing: A final hearing will be scheduled where the Tribunal will review the settlement and participant statements before issuing its decision.
Perth officials acknowledged that they are aware residents have been closely following the matter, however, while the case remains before the OLT, staff and council are restricted in what they can publicly discuss.
The town says full details will be released as soon as all parties sign off on the settlement, both on its Engage.Perth.ca portal and at their upcoming public meeting.
