Smiths Falls councillors Brennan, Robinson suspended following Code of Conduct breach

The Town of Smiths Falls has released an update following its review of comments made by Councillor Jay Brennan during the Jan. 5, 2026, council meeting.
A media release from the Town explains that at a Committee of the Whole meeting on Jan. 12, 2026, members reviewed the audio recording of the meeting and heard from those involved. During the review, Brennan expressed remorse and regret for his comments and issued a public apology to council, town staff and Smiths Falls residents.
Following the review, the committee determined the comments constituted a breach of the town’s Code of Conduct. The finding was not disputed by Brennan or by Councillor Stephen Robinson, who was also found to have breached the Code in relation to text message communications.
Council subsequently passed a motion to impose sanctions related to the breaches. Brennan will be suspended from council and committee meetings for 45 days with pay, while Robinson will be suspended for 15 days with pay.
Municipal councils in Ontario do not have the authority to impose financial penalties on members of council without a recommendation from an integrity commissioner.
“I acknowledge the findings and accept the outcome. I am deeply disappointed in myself and embarrassed by the incident. I respect Council’s decision and will comply fully,” Brennan said.
Mayor Pankow said council collectively agreed a breach of the Code of Conduct had occurred and acted within its responsibility to determine an appropriate response.
“Council has had a thorough and respectful discussion on this matter. We have received the acknowledgements and apologies that were required, imposed sanctions to the extent of our authority, and are now prepared to move forward by continuing to serve the community,” the mayor said.
